The 14 essays collected in this volume explore the various aspects of Augustine’s philosophy and its medieval reception: by considering his education and the development of his thought as conveyed by a series of philosophical images and styles, the volume reconstructs the recurring motifs of his intellectual journey (the anti-Manichean polemic, his political vision, the role of reason, and the theory of war) and their fortune in authors such as Thomas Aquinas, Nicole Oresme, Gregory of Rimini, and Robert Grosseteste.

​Authors, Factions, and Courts in Angevin England: A Literature of Personal Ambition (12th-13th Century) advances a model for historical study of courtly literature by foregrounding the personal aims, networks, and careers as the impetus for much of the period’s literature. The book takes two authors as case studies – Gerald of Wales and Walter Map – to show how authors not only built their own stories but also used popular narratives and the tools of propaganda to achieve their own, personal (...) goals. The purpose of this study is to overturn the top-down model of political patronage, in which patrons – and particularly royal patrons – set the cultural agenda and dictate literary tastes. Rather, Fabrizio De Falco argues that authors were often representative of many different interests expressed by local groups. To pursue those interests, they targeted specific political factions in the changeable political scenario of Angevin England. Their texts reveal a polycentric view of cultural production and its reception. The study aims to model a heuristic process which is applicable to other courtly texts besides the chosen case-studies. This paper analyzes selected examples of uses of argumentation tactics that exploit emotive language, many of them criticized as deceptive and even fallacious by classical and recent sources, including current informal logic textbooks. The analysis is based on six argumentation schemes, and an account of the dialectical setting in which these schemes are used. The three conclusions are (1) that such uses of emotive language are often reasonable and necessary in argumentation based on values, (2) but that they are defeasible, (...) and hence need to be seen as open to critical questioning (3) and that when they are used fallaciously, it is because they interfere with critical questioning or conceal the need for it. The analysis furnishes criteria for distinguishing between arguments based on the use of emotive words that are reasonable tools of persuasion, and those that are fallacious tactics used to conceal and distort information. Cet article se propose de décrire le projet épistémique des sciences des systèmes complexes. Domaine interdisciplinaire fondé par le Santa Fe Institute en 1984 aux États-Unis, il a été décrit par ses représentants comme un champ d’étude interdisciplinaire, post-laplacien, holiste et antiréductionniste. Des journalistes populaires et des sociologues intéressés et qui ont soutenu ce domaine en ont repris les discours, en annonçant l’avènement d’un nouveau paradigme révolutionnaire pour tous les savoirs. Dans ce texte, on montrera que le projet épistémique des (...) sciences de la complexité est moins pluraliste, antipositiviste et antiréductionniste que ce que l’on en dit. Je tâcherai de montrer en quoi le cadre épistémologique et ontologique de ce champ d’études reste analytique et réductionniste dans un sens physicaliste, computationnaliste, mathématique et biologisant. Legal definitions will be examined from three perspectives: their pragmatic function, their propositional structure, and their argumentative role. In law, definitions can be used for different pragmatic purposes: they can be uttered to describe a concept, or to establish a new meaning for a term. The propositional content of definitional speech acts can be different. In law, like in ordinary conversation, there might be different types of definition: we can define by providing examples, or showing the fundamental characteristics of the (...) concept defined, or listing the constituent parts of the denotatum. All these definitions play different argumentative roles in legal discourse. At a third level, definitions can be thought of as premises in complex patterns of reasoning (for the subject of reasoning from definition in law, see Aarnio 1977; Moore 1980; Lindahl, 2004). They constitute the fundamental element of argument from classification, namely a pattern of inference in which a new property (or a name) is attributed to an entity on the basis of other properties. Thomas Aquinas and Hervaeus Natalis share a correlational theory of intentionality. When I cognize a thing, I am in a real relation with the thing cognized and at the same time the thing is in a relation of reason with me. Hervaeus coins the term “intentionality” to designate precisely this relation of reason. First and second intentionality express two stages of this relation. First intentionality refers to the relation that a thing has to the mind, while second intentionality indicates the (...) relation that a thing qua cognized has to the mind. Thus, first intentionality involves direct cognition, while second intentionality reflexive cognition. This theory of intentionality has two purposes: first, to de-psychologize the cognitive process and second, to allow the application of Aristotle’s table of categories to the sphere of the mental. Through his detailed analysis of the relation of intentionality, Hervaeus clarifies some of Thomas’s obscurer points, but at the same time he has to solve a delicate problem of circularity entailed by the notion of intentionality as a relation of reason. In the history of ideas, innumerable attempts to explain life and to define living activities have invoked the notion of the soul. Yet this theoretical entity seems to be an unfathomable thing. Difficulties beset the mere definition of it, and controversies span from whether the soul is a material body or an immaterial form, an immortal or a mortal thing, a subject of experiential or of theoretical knowledge, to the question of whether it is the subject of a specific discipline (...) or rather of a scientia de anima that, in the Aristotelian tradition, was also regarded as a part of natural philosophy—the field of philosophy that deals with natural particulars. Not only was the soul thought, from a theological angle, to define the unity and unicity of living beings, but it was also seen as the source of several bodily activities such as nutrition and growth in living beings. And since some of the beings that grow and nourish themselves also sense and think, the relation of the origin of vegetative powers to the origin of perceptual and intellectual powers has always been an object of debate. In this sense, the soul has not just been a topic of one specific field, but has rather drawn upon many disciplines, combining the work of philosophers, religious thinkers, physicians, naturalists, chymists, and so on, thereby blurring the boundaries between different fields of knowledge. Botanical treatises of the Renaissance, for example, begin with the definition of the soul of plants and its primary role in bringing forth vegetal activities. Indeed, the presence of the soul was thought to be involved also in the life of animals, human beings, and, in some cases, it was even ascribed to minerals and stones, not to speak of the world-soul, the latent idea that the entire cosmos is animated with a soul. Furthermore, the theory of the materiality of the soul was developed since Antiquity and found new momentum in early modern times, in the reappraisal of Epicurean ideas by thinkers such as Guillaume Lamy, Pierre Gassendi, and Julian Offray de La Mettrie. Yet, with the Cartesian Henricus Regius, the understanding of vegetative, sensitive, and rational souls as material importantly surfaces as a peculiar attempt to mechanize the living functions of bodies. This paper argues for a reinterpretation of Aristotle's concept of an enthymeme and also his wider informal logic in terms of arguments that are defeasible. They are represented by forms of argument that are called argumentation schemes, considered to be similar to forms of argument found in deductive logic, but different from the foregoing in virtue of their being defeasible. Indeed, the most interesting schemes have been put forward as a helpful way of characterizing structures of human reasoning that have (...) proved troublesome to model deductively. The paper sheds new light on Aristotle's topics and how to dene `enthymeme'. If the traditional denition of an enthymeme in logic accepted for over two thousand years is a misnomer, the question is raised whether we ought to redene it as a defeasible argumentations scheme or leave things as they are. Unterscheidung zwischen vollständigen und unvollständigen Begriffen in Wirklichkeit eine Unterscheidung zwischen individuellen und spezifischen Wesenheiten/Essenzen ist; e) daß letzteres eine Differenzierung zwischen einem modal nicht-unterscheidenden und einem modal unterscheidenden Sinn von ”wesentlich“ voraussetzt; und schließlich f), daß die Unterscheidung zwischen Prädikation per se und Prädikation per accidens sich mit der Unterscheidung zwischen vollständigen und spezifischen Begriffen überschneidet. In the tradition stemming from Aristotle through Aquinas, rational decision making is seen as a complex structure of distinct phases in which reasoning and will are interconnected. Intention, deliberation, and decision are regarded as the fundamental steps of the decision-making process, in which an end is chosen, the means are specified, and a decision to act is made. Based on this Aristotelian theoretical background, we show how the decision-making process can be modeled as a net of several patterns of reasoning, (...) involving the classification of an action or state of affairs, its evaluation, the deliberation about the means to carry it out, and the decision. It is shown how argumentation theory can contribute to our understanding of the mechanisms involved by formalizing the steps of reasoning using argumentation schemes, and setting out the value-based criteria underlying the evaluation of an action. Representing each phase of the decision-making process as a separate scheme allows one to identify implicit premises and bring the roots of ethical dilemma to light along with the means to resolve them. In particular, we will show the role of framing and classification in triggering value-based reasoning, and how argumentation theory can be used to represent and uproot the grounds of possible manipulations. The aim of this study is to illustrate the role played by Augustine’s Commentary on the Genesis in the writings of Thomas Aquinas. This work is of great importance for Aquinas, not only because it is the work where Augustine clarifies his interpretation of creation, but also because creation is, among the theological topics, perhaps the most philosophical, insofar as it gives the opportunity of elaborating on many philosophical issues. In particular, the goal of the study is to rethink the (...) positions of Aquinas and Augustine on one of these issues, that is the relationship between soul and body. I mean to call into question two historiographical theses: first, that Augustine and Aquinas formulate positions that are irreconcilable with each other, and second, that they in no way address that which we today call the Mind-Body Problem. The theology of Pier Damiani († 1072) is still an understudied theme in his scholarship, in particular, for what it concerns his Trinitarian and Christological doctrines. The aim of this study is to reconstruct and discuss especially Damiani’s Christological views as formulated in Letter 81, better known as his De fide catholica. It is argued that Damiani’s approach is mostly exegetical, as he mainly points to and comments on Biblical passages in support of Catholic doctrines. Still, he assumes a peculiar (...) method of investigation, as he devotes the main body of the Letter to the question of the correct understanding (recta intelligentia) of the Catholic interpretation of Christology, and reserves only the final summary to a discussion of Biblical authorities. Eventually, it is argued that despite Damiani’s attempts at clarifying the matter, he acknowledges an inherent difficulty in explaining how it is possible that God became man without truly assuming the person of man, and, if He did so, how this did not give rise to two, however indistinct, persons or hypostases. The concept of ‘co-union’ of human and divine natures, introduced by Damiani, makes the simultaneous unity and distinction of the two natures intuitively clear, but it remains a concept that is not clarified in all its details and implications. En La Verdad de la Ficción, Mario Presas compila nueve artículos de su autoría que, aunque fueron escritos en distintos momentos de su carrera y sin una conexión sistemática, están estrechamente ligados entre sí por una misma problemática filosófica: la apertura, a través del arte, a un tipo de saber que es propio de la experiencia estética. La tesis central que atraviesa a todos los capítulos consiste en sostener que el arte habilita una vía de acceso a la realidad que (...) no puede subsumirse ni reducirse a otros tipos de saber, en particular, al conocimiento científico. El autor sostiene que el saber que brinda la experiencia estética es insustituible en relación a la ciencia, sin que por ello uno de los dos tenga primacía sobre el otro. (shrink)

This paper attempts to provide a general reconstruction of Francis of Marchia's doctrine of accidental being. The paper is divided into two parts. (1) In the first part, I begin by reconstructing the debate on the nature of accidents held before Marchia, showing that such a debate is characterised by a progressive shift concerning the way to understand accidents. While the first Aristotelian interpreters regard accidents especially as inhering modes of being of substances, the majority of theologians and philosophers in (...) the second half of the thirteenth century regard accidents as absolute beings. For them, the problem is no longer to explain if and, if so, how accidents can be distinct from substances, but how accidents and substances can make some one thing. Metaphysically, their primary focus is on explaining what the ontological status of inherence is. Although it is especially the consideration of the Eucharistic case that induces this change, I point out that many philosophers and theologians find in Aristotle's texts the philosophical support for taking this step. (2) In the second part, I focus more closely on Marchia's doctrine, arguing that Marchia's position is a slightly revised version of Scotus's. Unlike Aquinas and Bonaventure, Marchia explains Aristotle's metaphysics of accidents by way of the metaphysics of the Eucharist and not vice versa. So, in order to explain the philosophical consistency of this miraculous case, Marchia maintains that one does not need to modify the notion of inherence by distinguishing actual from potential inherence and including the latter in the accident's essence; rather it is necessary to take the case of the Eucharist seriously and, on this basis, to remove inherence totally from an accident's essence. In conclusion, the Eucharist shows that accidents are absolute beings to which actual inherence pertains contingently, potential inherence necessarily. But like Scotus's, Marchia's doctrine faces some difficulties that remain unresolved. (shrink)

So far, legal translation studies have generally been concerned with multilingual legislation, which they have dissected using comparative law methods. The time seems to have come for a differentiated research that recognises various types of legal translation, including the category of translation by professionals for public authorities and business concerns. This latter category’s context is rapidly changing. Globalization is aggravating the crisis of national legislation. First and foremost, networks of authorities have sprung up alongside international organisations. The texts translated are (...) regulatory rather than prescriptive. Then, in the field of international commerce, a standardization of contracts is occurring. Globalized administrative and commercial varieties of English are no longer the English of the common law but, rather, a neutral or hybrid English that needs to be further sub-classified by reference to specific legal sectors. Furthermore, by reducing costs and deadlines, globalization and digitalization have forced translation to be economically efficient. Several legislative provisions now allow the translation of legal texts by way of extracts or summaries. In multilingual monitoring translators are being asked to assess and select the documents for translation themselves. The quality required is often that which is “sufficient” to achieve the sought-after goal. All these changes must be incorporated into the university education of translators. (shrink)

Lo studio si concentra sul modo in cui i commenti alla Metafisica di Paolo di Venezia e Alessandro di Alessandria evidenziano il grado di modificazione della comprensione della dottrina aristotelica sull'essenza, dovuta alla ricezione della dottrina di Tommaso d'Aquino e di Averroè al riguardo. Dopo un'introduzione di inquadramento storico dottrinale dei due commenti, la seconda parte è centrata sulle dottrine dei due maestri relative all'essenza, e l'A. articola la sua ricognizione attorno ai temi del rapporto fra essenza e sostanza, essenza (...) e predicazione, e sulla rispettiva ricezione della dottrina tomista sull'essenza, fondata a sua volta sulla dottrina avicenniana . La terza parte verte su una puntuale ricostruzione della dottrina dell'essenza in Paolo, mentre la quarta evidenzia come Alessandro sia la fonte primaria di Paolo. L'A., infine, esamina il commento di Alessandro in relazione al tema dell'essenza. Nella conclusione ribadisce come Alessandro e Paolo tentino di riconciliare la dottrina averroista con Aristotele, adottando l'interpretazione di Tommaso. Tra i testi dell'Aquinate utilizzati si ricordano il De ente et essentia, il commento alla Metaphysica e quello alle Sentenze, la Summa theologiae. (shrink)

When Ockham's logic arrives in Italy, some Dominican philosophers bring into question Ockham's ontological reductionist program. Among them, Franciscus de Prato and Stephanus de Reate pay a great attention to refute Ockham's claim that no universal exists in the extra-mental world. In order to reject Ockham's program, they start by reconsidering the notion of 'real', then the range of application of the rational and the real distinction. Generally, their strategy consists in re-addressing against Ockham some arguments extracted from Hervaeus Natalis's (...) works. Franciscus's and Stephanus's basic idea is that some universals are not acts of cognition, but extra-mental, predicable things. Such things are not separable from singulars, nonetheless they are not the same as those singulars. Consequently, it is not necessary to allow, as Ockham does, that if two things are not really identical, they are really different and hence really separable. According to them, it is possible to hold that two things are not really identical without holding that they are also really non-identical and hence really different. Basically, their reply relies on a different notion of the relation of identity. Identity is regarded as an intersection of classes of things, so that it is possible to say that two things are really identical without saying that they also are the same thing. Franciscus and Stephanus, however, do not seem to achieve completely their aim. (shrink)

L’article présente l’édition critique du Traité sur l’être de raison de François de Prato, précédée d’une introduction historico-philosophique. Ce traité est une des premières réactions italiennes à la diffusion de la philosophie du langage et de la logique de Guillaume d’Occam. François y argumente contre la réduction occamiste de l’être de raison aux actes de connaissance, entendus comme des entités existant ‘subjectivement’ dans l’intellect. En suivant Thomas d’Aquin et Hervé de Nédellec, il développe au contraire une théorie relationnelle et ‘objective’ (...) de l’être de raison. (shrink)

A pesar de que el concepto de formatividad surja y se desarrolle en el contexto específico de la estética, su importancia va mucho más allá de los límites de un ámbito o una etapa determinados de la especulación filosófica de Pareyson. A nuestro entender, la relevancia de este concepto estriba en su universalidad y en el hecho de que permite arrojar luz sobre la naturaleza de la interpretación, específicamente, sobre su modo concreto de funcionar. Desde este punto de vista, la (...) formatividad representa, además de una adquisición definitiva para la hermenéutica de Pareyson, también un aporte fundamental para la hermenéutica en general. La primera parte del artículo pretende demostrar que la formatividad es el interno «secreto» de la interpretación y la razón de ser de su universalidad. La segunda parte intenta ilustrar el rendimiento del concepto de formatividad (es decir, lo que con él concretamente se gana) para la vigencia, alcance y fecundidad de la hermenéutica. (shrink)

_Formatividad_ es el concepto clave de la estética de Luigi Pareyson, pero también de su hermenéutica filosófica. El artículo no se propone ilustrar la teoría estética de Pareyson sino: analizar en qué consiste esa formatividad intrínseca a toda actividad humana ; aclarar porqué la formatividad nos obliga a concebir el conocimiento como interpretación y, por tanto, a legitimar la hermenéutica ; señalar algunas implicaciones de tal hermenéutica susceptibles de importantes y fecundos desarrollos.

L'A. si occupa della ricezione della logica occamista, soprattutto in Stefano da Reate , dedicata in grande parte alla confutazione della nova loyca, rappresentata soprattutto dalla Summa logicae di Ockham. Stefano informa anche sulla grande presenza presso i Domenicani del commento di Pietro d'Alvernia all'Isagoge di Porfirio oltre allo Scriptum super Artem veterem di Graziadei da Ascoli. Accanto a questi testi sono utilizzati anche il Tractatus de sencundis intentionibus e i Quodlibeta di Erveo Natale. L'A. esamina un caso esemplare del (...) dibattito tra Ockham e i Domenicani italiani riguardante la natura del genere. Esiste solo un altro caso di rifiuto del pensiero occamista, quello della Loyca di Francesco da Prato. Francesco e Stefano mostrano di essere soprattutto interessati alla confutazione del programma riduzionista di Ockham. L'A. prende in esame l'interpretazione di Francesco e Stefano sull'Isagoge di Porfirio. (shrink)

There is a chapter in the history of ideas which, at least since the 1960s, appeared to have been definitively resolved. French Marxism of the 1930s has thus been reduced, whether by its supporters and opponents or by historians, to the status of a mere avatar of Stalinist diamat, albeit with certain variations which can be traced back to the national heritage of materialism and rationalism. The paper presents the main results of a research project whose purpose is to reconstruct (...) the developments which have led to the formation of such an image. The aim is to recover the possibility of apprehending afresh the various competing trends which, at the time, were engaged in a discursive struggle, the object of which was the definition of dialectical materialism. Hegel’s name, invoked in the context of epistemological discourses and to oppose the dominant academic tradition, thus emerges as a major philosophical reference for those currents which, at the termination of this ideological conflict, ended up on the defeated side. À partir des résultats d’une recherche-formation, la contribution vise à analyser la pluralité des représentations d’un genre minoritaire de séparation : l’incertain. Conçu comme une rupture relationnelle entre le sujet et les routines du quotidien, l’incertain implique un processus de reconfiguration du sens et de l’identité. Ce processus peut amener la personne à se concevoir comme ex de soi-même. Dans cette direction, la contribution s’adosse à une posture épistémologique et méthodologique de type compréhensive-transactionnelle pour explorer les transactions identitaires de jeunes (...) étudiantes face à l’incertain. Quatre formes de séparation et quatre figures d’ex-soi-même sont envisagées afin de souligner la diversité des postures actionnelles assumées pendant des situations d’incertitude. (shrink)

Quels sont l’origine et le sens du « sens esthétique »? Est-il codé génétiquement ou culturellement hérité? Le but de l’essai est de répondre à telles questions en définissant l’émergence et le caractère méta fonctionnel de l’attitude esthétique. Tout d’abord, je propose d’inclure la faculté de désir dans le libre jeu des facultés cognitives au centre de la Critique de la faculté de Juger de Kant. Ensuite, j’examine le caractère de survenance de l’esthétique et sa valeur d’anticipation. En discutant quelques (...) perspectives évolutives contemporaines sur l’esthétique, je considère en conclusion la nature épigénétique de l’esprit esthétique. (shrink)

Le point de départ de l’article est offert par une reprise du point de vue de l’esthétique du célèbre essai de Hilary Putnam, Fait/Valeur : la fin d’un dogme. La première étape consiste dans une analyse des propriétés esthétiques et des jugements connexes avec elles comme un cas paradigmatique du dépassement de la vieille dichotomie. La thèse ici défendue est que les jugements esthétiques sont cognitifs d’une manière non conceptuelle, et normatifs sans présupposer des normes définies. En unissant dans un (...) seul terme des niveaux de descriptivité négative avec des niveaux d’évaluation (positive), les jugements esthétiques mettent irréversiblement en crise la solidarité de physicalisme et d’émotivisme. Par conséquent, l’article poursuit l’objectif d’une déduction au sens kantien des jugements esthétiques, en unifiant, au moins du point de vue méthodologique, les deux niveaux de l’enquête que Kant maintient stratégiquement distincts, à savoir le plan d’une exposition empirique (physiologique) des jugements esthétiques et celui d’une exposition transcendantale. Le noyau théorique de la déduction est l’idée d’un « mécanisme esthétique » sous-jacent comme la base naturelle pour l’épigenèse de l’esthétique. (shrink)

Ernesto de Martino made a seminal contribution to the study of vernacular religions, producing innovative analyses of key concepts such as folklore, magic and ritual. His methodology stemmed from his training under the Italian philosopher Benedetto Croce whilst his philosophical approach to anthropology borrowed from Marx and Gramsci.Widely celebrated in continental Europe, de Martino's contribution to the study of religion has not been fully understood in the Anglophone world though some of his works - Primitive Magic: the Psychic Powers of (...) Shamans and Sorcerers and The Land of Remorse: a Study of Southern Italian Tarantism - have been translated.This book presents a comprehensive overview of de Martino's work and the thinkers and theories which informed his writings. It assesses his contribution to the study of religions and the potential of his methodology for contemporary scholarship. (shrink)
